These campaigns can include newsletter subscriptions, promotions, new product announcements, and more.

2. Legal Framework and Consent Requirements

2.1 Applicable Regulations

This policy is based on:

  • Article 82 of Law N°78-17 of January 6th, 1978 (French "Informatique et libertés" law)

  • Directive 2002/58/EC (ePrivacy Directive)

  • Regulation (EU) N°2016/679 (GDPR)

3.3 Data Usage Limitations

Wisepops does not:

  • Store information that would allow direct visitor identification

  • Sell or share visitor email addresses or personal information collected via pop-up forms

  • Send emails or directly contact visitors for any purpose

4. Consent Requirement Analysis

Wisepops' cookies primarily qualify as audience measurement cookies or user choice retention trackers. As such, they are generally not subject to prior consent requirements.

However, Clients should note:

  1. If using Wisepops to collect personal information (e.g., name, phone number, email address), additional consent may be required.

  2. Clients, as data controllers under GDPR, are responsible for providing required information to website visitors regarding personal data processing.

5. Client Responsibilities

Clients using Wisepops are solely responsible for:

  1. The content published through Wisepops Services on their website

  2. Processing of personal data performed in the context of using Wisepops Services

  3. Compliance with all applicable laws and regulations, particularly those related to personal data protection
