Introduction to Wisepops Services
Wisepops is an on-site marketing solution that provides website owners (hereinafter referred to as the "Clients") with the ability to display targeted campaigns in the form of:
Pop-ups (banner or window)
WISP notifications (icon or drawer hidden or revealed at the Client's request)
Bars
Embeds
These campaigns can take the form of subscriptions to newsletters, promotions, new product announcements, and more.
The purpose of this notice is to document Wisepops' position that the use of the Services by the Client does not, per se, require it to collect its website visitors' prior consent.
In any case, the Client is solely responsible for (i) the content of the Services that it publishes on its website, and (ii) the processing of personal data that it may be performing in the context of the use of the Services, as a Controller pursuant to the GDPR.
Information We Collect
Browsing Information
For internal targeting purposes, we collect certain details about your browsing history on websites where Wisepops has been implemented. This information helps us determine if you match a particular display scenario set by the website owner. The details include:
Your last visit to the website
The campaigns you have interacted with
Any additional information attached to your visit by our customer (e.g., your last purchase date)
Important privacy notes:
This data stays in cookies on your device
We don't store it on our servers
Other apps can't access it
We don't track across different websites
You can clear these cookies anytime through your browser
Personal Details
Website owners may use Wisepops to collect personal information through popup forms. These details may include:
Email address
Name
Phone number
IP address and country (for spam prevention)
How we handle this data:
Stored securely on our servers
Accessible only by website owner and Wisepops staff
Shared with authorized services (like Mailchimp) only with website owner approval
Never used to directly identify you

Consent Requirements
According to CNIL Guidelines, consent is not required for operations that:

Audience Measurement Trackers
To be exempt from consent, audience measurement trackers must:
Have a purpose that is strictly limited to the sole measurement of the audience on the site or application for the exclusive account of the publisher
Not enable global tracking of a person's browsing habits using different applications or browsing different websites
May only be used to produce anonymous statistical data
The personal data collected may not be cross-referenced with other processing nor transmitted to third parties
Wisepops ensures that it complies with the above mentioned criteria in order for its Services to qualify, per se, as exempt from consent pursuant to the CNIL Guidelines.
Wisepops Cookies
Wisepops uses first-party cookies on the Client's website to define browsing scenarios and display contextual pop-ups. These cookies are linked to the Client's domain, not Wisepops'.

wisepops_noshow | 2 years | Disables Wisepops' Services when a visitor clicks "Don't show pop-ups again". |
wisepops_props | 2 years | Stores custom properties across sessions (shopping cart composition, purchase history) to define the context in which the pop-ups are displayed. |
wisepops_visits | 2 years | Stores the last 10 visit dates. |
wisepops | 2 years | Stores persistent data to align the visitor's experience with the pop-ups that are displayed to him/her: 1. History of pop-ups displayed to the visitor in order to avoid displaying the same pop-up. 2. Information that the visitor's email has already been collected to avoid asking him/her again. |

Safari: 7-day expiration (due to ITP 2.1 privacy update)

You can choose to use the browser's local storage instead of cookies, which allows your popups to function even if the client refuses cookies

How Collected Lead Data is Handled
When you collect visitor information through Wisepops forms:
By default, we store collected leads for several main purposes:
Providing backup export capability in case of sync failure with your ESP (Email Service Provider)
Enabling lead deduplication to prevent users from submitting the same email or phone number multiple times
Supporting additional data processing needs for your marketing campaigns
We offer an option to disable permanent lead storage:
If this option is enabled, leads will still be temporarily stored for up to 24 hours on our servers before being automatically deleted
Please note that disabling storage will remove access to backup exports and lead deduplication features
This configuration can be applied to specific websites within your account

Website Owner Responsibilities
As a website owner using Wisepops, you are solely responsible for:

Personal data processing compliance
Providing required privacy information to visitors
Meeting applicable legal requirements
Important Note: Although the cookies involved by the use of Wisepops Services are not per se subject to your website visitors' prior consent, if you use Wisepops to collect personal information (e.g. visitor's name, phone number, email address) through pop-up forms, the purpose of such processing may subject you to the legal requirement of obtaining the consent of your website visitors prior to implementing the cookies.
Personal Data Removal
If you wish to have your personal details removed from our servers, please email us at support@wisepops.com. We will delete all the information we have about you within two working days.
